Terms and Conditions

These terms and conditions apply to all purchases made from Excel in Property, including but not limited to Academy memberships, courses, tools and downloads, and to your use of our website. Please read them before placing an order or using the website. By ticking the box at checkout to accept these terms and conditions and completing your order, you agree to be bound by them.

01

Who we are

This website, excelinproperty.com, is operated by Excel in Property Limited, a company registered in England and Wales under company number 12339828, whose registered office is 167-169 Great Portland Street, 5th Floor, London, W1W 5PF. Our email address is [email protected]. In these terms, "we", "us" and "our" mean Excel in Property Limited, and "you" and "your" mean the individual or business placing the order.

02

What these terms cover

These terms cover everything we sell, including but not limited to Academy memberships, individual courses, tools and downloads, and any one-to-one or live sessions that come with them.

We refer to all of these as the "Products". The contents of each Product are those described on our site at the time you place your order.

03

Eligibility

You may buy as an individual or on behalf of a business. By placing an order you confirm that:

- you are at least 18 years old and have the legal capacity to enter into a binding contract;

- the information you provide is accurate and not misleading; and

- if you are buying on behalf of a business, you have authority to bind that business.

04

Formation of the contract

4.1 Once you place an order, we will send you an email acknowledging it. That acknowledgement does not constitute acceptance of your order.

4.2 The contract between us is formed when we email you to confirm that the Product is available or when we give you access to it, whichever happens first.

4.3 If you have made an error in your order, please email us at [email protected] as soon as possible and we will endeavour to correct it.

4.4 We may decline an order, for example where we are unable to verify your payment. In that case we will not take payment, or we will refund in full any payment taken.

05

Your licence and the 12-month access period

5.1 Unless section 5.5 or 5.7 provides otherwise, each Product is licensed to you for 12 months from the date of purchase (the "Access Period"). The Access Period ends automatically at the end of the 12 months. No Product renews automatically, and we will not take any further payment unless you choose to renew.

5.2 During the Access Period you may use the Product as often as you wish. The Access Period cannot be paused, suspended or extended, whether or not you have used the Product during that time.

5.3 If you wish to continue after the Access Period has ended, you may renew in the manner shown on our site, at the price and on the terms in force at that time.

5.4 Except as set out in section 5.5, access is not lifetime access. When the Access Period ends, you will no longer have access to the Product or to any updates to it. You are responsible for retaining any records you need, such as certificates and your own notes.

5.5 The Financial Modelling Crash Course is the exception to the 12-month Access Period. It is licensed without a time limit, and you may access it for as long as we continue to offer it. Sections 5.1, 5.3 and 5.4 do not apply to it.

5.6 If we add new courses or materials to the EiP Academy, you will have access to them for as long as you remain an active member of the Academy.

5.7 Existing Academy members. Members who joined the EiP Academy on a monthly or annual subscription before the introduction of the 12-month membership may remain on that subscription. It renews automatically at the interval chosen and may be cancelled at any time. Cancellation takes effect at the end of the period already paid for, and no refund is given for that period. Sections 5.1, 5.3, 5.4 and 7.2 to 7.4 do not apply to a subscription while the member remains on it.

5.8 Upgrading to the Career Accelerator. An existing subscriber who upgrades to the Career Accelerator will pay the difference between the price of the Tier 1 Academy membership and the price of the Career Accelerator, each being the price shown on our site at the time of the upgrade, together with any applicable VAT. The price the subscriber currently pays is not used to calculate the difference. The difference may be paid in full or in monthly instalments as set out in section 7.2. The upgrade starts a new 12-month Access Period on the date of the upgrade. The subscriber commits to the full 12 months, the subscription cannot be cancelled during that period, and the subscriber continues to pay at the rate they currently pay. The remainder of these terms will apply to the Career Accelerator membership from the date of the upgrade.

06

Named user licence

6.1 Each licence is personal to one named individual. You must not share your login details, the Products or any related materials with any other person, including colleagues, friends or family members.

6.2 Individual purchasers. A licence purchased by an individual cannot be transferred to any other person.

6.3 Business purchasers. Where a business purchases one or more licences, each licence must be assigned to a named employee or team member. If that person leaves the business, the business may reassign the licence to another colleague for the remainder of the Access Period, provided it notifies us by email at [email protected]. The previous user's access will then end. A licence may not be used by more than one person at a time.

6.4 If we reasonably believe that a licence is being shared, we may suspend or terminate access without refund.

07

Payment

7.1 The price is the price shown on our site at the time of your order, save in cases of obvious error. We are not currently registered for VAT, so prices are shown without VAT. If this changes, we will make clear whether VAT is included in or added to the price.

7.2 For Academy memberships you may choose one of two payment options:

- Pay in full: you pay the full price at the time of your order and receive 12 months of access.

- Monthly instalments: you pay 12 equal monthly instalments, the first at the time of your order and the remainder on the same date each month. You receive 12 months of access.

7.3 If you choose monthly instalments, you authorise us to collect each instalment automatically from the payment method you provide, without further notice. The instalment plan is a commitment to pay the full price over 12 months. It does not renew automatically: no further payment will be taken after the twelfth instalment, and your Access Period ends 12 months after the date of purchase.

7.4 If an instalment payment fails, we will contact you and you must pay the overdue amount within 7 days. If you do not, we may suspend your access until payment is made. You remain liable for all remaining instalments even if your access is suspended or terminated.

7.5 Individual courses and tools are a single payment for a licence for the Access Period. They do not renew automatically.

7.6 You may use a Product only once we have received payment or, where you pay by instalments, the first instalment.

7.7 Businesses may request an invoice. Where we agree to invoice you, payment is due within 21 days of the invoice date, and we will give you access to the Products only once the invoice has been paid in full.

08

One-to-one and live sessions (Career Accelerator)

8.1 The Career Accelerator includes six one-to-one sessions with Lucy Gordon, each lasting 60 minutes. One of these is a career roadmap session, in which we work with you to set out your personal career roadmap, covering your current position, your goals and the skills and steps required to reach them. It also includes live group sessions.

8.2 You will book your one-to-one sessions through a calendar link, which we will send to you after you join. You must book and use your one-to-one sessions within your Access Period. Unused sessions expire at the end of the Access Period and are not refundable or capable of being carried over.

8.3 If you need to reschedule a one-to-one session, you must give us at least 48 hours' notice. If you cancel or reschedule with less notice, or do not attend, the session will be treated as used. If we need to reschedule a session, we will offer you an alternative time.

8.4 If you are unable to attend a live session, a recording will be made available to you. We do not provide refunds for sessions you do not attend.

8.5 We may change the dates, times and format of live sessions and the person delivering them. We will give as much notice as is reasonably practicable.

8.6 We record live sessions. If you take part, you agree that your image, voice and questions may appear in the recording and that we may use it for training and promotional purposes. Please tell us in advance if you would prefer not to appear.

09

Certificates and CPD

9.1 We state the CPD hours for each Product on its page, and you will receive a certificate on completing a course.

9.2 CPD requirements vary between professional bodies. You are responsible for checking that our CPD hours meet your own requirements. We do not guarantee that any professional body will accept them.

10

Model Library, downloads and tools

10.1 Spreadsheet models, templates, checklists and other downloads, including everything in the Model Library, are provided for educational purposes only. You may use them to learn and to practise the techniques we teach.

10.2 You must not sell, share, publish, upload or otherwise make them available to any other person, or use them to create a competing product or training. You must not upload them to any AI tool or public site in a way that makes them available to others.

10.3 Our models and templates are learning examples. They are not designed for, and must not be relied on in, real transactions or other real-life decisions. If you choose to adapt or use any model, template or output outside your learning, you do so entirely at your own risk, and we accept no responsibility for any loss that results.

10.4 Our models and templates are not suitable for commercial use, and we have no liability or responsibility for any use of them. Your access to the Model Library ends when your Access Period ends, and you will no longer receive new or updated models. All models, templates and other Model Library content remain the property of Excel in Property at all times. After your access ends you may keep copies you have already downloaded for your own learning only. You must never use them for commercial purposes, whether or not you are a member of the EiP Academy.

11

Intellectual property

11.1 We own, or are licensed to use, all intellectual property rights in the Products, including the videos, course materials, models, templates and branding.

11.2 We grant you a limited, personal, non-exclusive, non-transferable licence to use the Products for the Access Period, for your own learning and professional development only, subject to sections 6 and 10. Section 10.4 applies to downloaded copies after the Access Period ends.

11.3 You must not copy, record, screen-capture, reproduce, resell, distribute or publish any part of the Products without our prior written consent. You must not use our name or logo without our prior written consent.

11.4 This section continues to apply after your access ends.

12

No professional advice

12.1 The Products are provided for training and educational purposes only. They do not constitute financial, investment, legal, tax or valuation advice, and we do not advise on your individual circumstances.

12.2 We do not guarantee any particular outcome, such as a promotion, employment, a qualification or investment performance. Outcomes depend on many factors outside our control.

12.3 We take reasonable care to keep the Products accurate and up to date. However, market practice, rates and regulations change, and we are not responsible for any loss arising from your reliance on examples or figures in the Products.

13

Cancellation and refunds

13.1 Because access to the Products is given immediately, we do not offer refunds once your order has been accepted and access has been given, whether or not you have used the Product. This applies to Academy memberships, individual courses and tools, and to any purchase paid for in instalments.

13.2 The Access Period begins on the date of purchase and cannot be paused, deferred or extended. We do not offer refunds, credits or additional access where you have chosen not to log in, or where you have been unable to use the Product for reasons personal to you. Where a technical fault on our side has prevented you from accessing the Product, we will provide additional access to make up for the time lost.

13.3 Consumers. A consumer (an individual acting for purposes wholly or mainly outside their trade, business, craft or profession) would ordinarily have the right to cancel a contract for digital content or services within 14 days. By ticking the box at checkout to accept these terms and conditions, you:

- request that we give you access to the Products and begin the services immediately;

- agree that we may supply digital content before the 14-day cancellation period has ended; and

- acknowledge that, as a result, you lose your right to cancel once access has been given.

13.4 Business purchasers. A business purchaser has no right to cancel or to a refund.

13.5 Your statutory rights. Nothing in these terms affects your statutory rights as a consumer. If a Product is faulty or not as described, you may be entitled to a repair, replacement or refund. If you believe there is a problem, please email us at [email protected] and we will endeavour to resolve it.

14

Access and support

14.1 Access is sent to you by email immediately when your order is confirmed. If you experience any issues, please email us at [email protected] and we will endeavour to respond within 2 business days.

14.2 Our Products are hosted on third-party systems. We take reasonable steps to keep them available but cannot guarantee uninterrupted availability, and we are not liable for short interruptions.

14.3 To use the Products you will need a Windows computer, an internet connection and a current version of Microsoft Excel for Windows. Our courses, models and downloads are designed for Excel on Windows and may not work as shown on a Mac or other devices.

15

Termination

15.1 We may terminate your access immediately and without refund if you commit a serious or repeated breach of these terms, for example by sharing your licence or copying the Products.

15.2 If you terminate the contract yourself, other than in exercise of a right you have by law, no refund will be due and, if you chose monthly instalments, the remaining instalments will remain payable.

15.3 Sections that are intended to continue after the contract ends, including sections 11, 12, 16 and 18, will continue to apply.

16

Our liability

16.1 We will provide the Products with reasonable skill and care. If you are a consumer, digital content will be of satisfactory quality, fit for its purpose and as described.

16.2 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

16.3 Subject to section 16.2, where you are buying for a business, we are not liable for loss of profit, loss of business, loss of contracts or anticipated savings, loss or corruption of data, or any indirect or consequential loss.

16.4 Subject to section 16.2, our total liability to you arising out of or in connection with a Product is limited to the price you paid for it.

16.5 If you are a consumer, we are responsible only for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care. We are not responsible for business losses.

17

Events outside our control

We are not responsible for any failure or delay caused by events outside our reasonable control, including illness or incapacity of the person delivering the training, internet or hosting failures, and industrial action. If such an event occurs, we will notify you and take reasonable steps to perform our obligations as soon as reasonably practicable.

18

Changes to the Products and these terms

18.1 We may update, improve or reorganise the content of the Products, including by replacing models or lessons with newer versions. We will not remove anything in a way that materially reduces what you paid for during your Access Period.

18.2 We may amend these terms from time to time. The terms in force when you place your order apply to your purchase. If we amend them in a way that affects an existing order, we will notify you by email in advance and, where the change is not required by law and you do not accept it, you may contact us to discuss your options.

19

Data protection

We will process your personal information in accordance with our Privacy and Cookie Policy, which is available at https://excelinproperty.com/privacy-policy. You are responsible for keeping your login details confidential and must notify us immediately if you believe anyone else has used your account.

20

General

20.1 Communications. We will usually contact you by email and by notices on our site. You agree that these constitute written communication.

20.2 Assignment. You may not transfer your rights or obligations under these terms, except where section 6.3 permits a business to reassign a licence. We may transfer ours to another company, provided this does not reduce your rights.

20.3 Entire agreement. These terms, together with your order and the description of the Product on our site, constitute the entire agreement between us in relation to the Product and supersede any prior statements or understandings.

20.4 Severance. If a court finds any part of these terms unenforceable, the remainder will continue to apply.

20.5 Waiver. A delay in or failure to enforce a right does not prevent us from enforcing it later.

20.6 Third parties. No person other than you and us has any rights under these terms by virtue of the Contracts (Rights of Third Parties) Act 1999.

20.7 Governing law and jurisdiction. These terms, and any dispute arising out of or in connection with them, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts. If you are a consumer living elsewhere, you may also have rights under your local consumer law that we cannot take away.
